Schending concurrentiebeding vastgesteld? Is een ex-medewerker er met uw klanten vandoor gegaan. Of voert uw compagnon heimelijke gesprekken met uw zakelijke relaties? Schending van een concurrentiebeding leidt vaak tot grote schades. Niet alleen financieel, maar ook op emotioneel vlak. Sommige ondernemers zien hun levenswerk in rook opgaand, doordat ze de verkeerde personen hebben vertrouwd.

Ook directe familie <\/strong>

Zelfs broers, zoons of vaders schenden wel eens een concurrentiebeding. Afgunst, jaloezie en financieel gewin vormen de grootste redenen om de eigen familie te benadelen. Wat de schending van het concurrentiebeding extra schadelijk maakt is de vaak onherstelbare schade. Juist omdat een familielid het meest wordt vertrouwd, is de verrassing onaangenamer van aard. Familiebanden zijn soms jaren op de proef gesteld. Relaties zijn moeizaam of zijn kapot.

Concurrentiebeding onderzoek<\/strong>

Door een schender van een concurrentiebeding te achtervolgen wordt duidelijk welke relaties hij bezoekt. Als sprake is van een patroon, dan maakt dat de schender schadeplichtig. Er kan een boetebeding worden ingeroepen, omdat dat nu juist in het concurrentiebeding staat vermeld. Daar heeft iedere contractpartij voor getekend.

Resultaat en bewijskracht<\/strong>

De waarnemingen en videobewijs worden in een rapport dat voor de Rechtbank geldt opgeschreven. Vaak dwingt de rechter tot staking van de activiteiten en zal hij het boetebeding in werking stellen. Schendingen van een concurrentiebeding worden in een patroon vastgesteld zodat het bewijs onomstotelijk is. Vaak is de relatie met het familielid niet meer te herstellen, maar een bedrijf kan nog wel overleven. Maar dat gaat nooit zonder blijvende schade. Klanten kunnen zich alsnog afwenden en een andere leverancier zoeken. Het is dan een belangrijke taak voor de ondernemer om de banden met de klanten opnieuw aan te halen.
